Site Usage

If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. D-Tech Performance Ltd reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion subject to below.

Contract
These terms of sale apply to all goods supplied by D-Tech Performance Ltd. whose trading details are available in the "about us" section.

Ordering Goods
All orders are subject to stock availability.

To order goods from our online store simply click the “Buy Now!” or "Add to Cart" button on the product information page.
The product will be placed in your “Cart”. After making your selections use the "Checkout" button.
You will be able to review and amend your order before proceeding through the checkout pages.
If you have an existing account with us, you will be asked to log in, otherwise you will be asked to Create an Account.
We will ask for details of your Shipping and Billing addresses.
The Billing Address MUST be the address at which your Credit/Debit card is registered, and email/phone contact details so we can contact you if we need to discuss your order.
At the end of the Checkout process a page will display confirming the details of your order for your records. If you need to amend your order after it has been generated, please contact us by email : info@d-techperformance.co.uk We will confirm receipt of your order by sending an email to you using the email address you supplied.
All items purchased from us are made pursuant to a delivery contract.
This basically means that the risk of loss and title for such items pass to you upon our delivery to the relevant delivery service.
No contract exists between you and D-Tech Performance Ltd. for the sale of any goods until D-Tech Performance Ltd. has received and accepted your order and has received payment in full (in cleared funds).

Once D-Tech Performance Ltd has recieved the above, there is a binding legal contract between us. The contract is subject to your right of cancellation (see note below).

D-Tech Performance Ltd. may change these terms of sale from time to time without notice to you, in relation to future sales.
All prices stated on the website are inclusive of VAT, but exclusive of delivery costs, except where stated.
Prices and availability of products may be changed at any time without prior notice.

Payment
Payment for the goods and delivery charges can be made by any method shown on the website at the time you place your order.
We accept payment by most major credit/debit cards or UK cheques. Payments will be debited to your account before the despatch of your order.
There is no surcharge for the type of payment used.
Payment shall be due before the delivery date. There will be no delivery made until cleared funds are received.

All credit and charge card holders are subject to validation checks and authorisation by the card issuer.
If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery of your order.
We may need to contact you by letter, telephone or email to verify details before we are able to dispatch your order or we may be unable to accept your order.
This is why we collect some of the details from you in the registry procedure.

Data Protection
D-Tech Performance Ltd will take all reasonable precautions to keep the details of your order and payment secure but unless we are negligent, we will not be liable for unauthorised access to information supplied by you.

Liability
D-Tech Performance Ltd are not liable for loss of profits, loss of business or other consequential, special or indirect loss arising out of the use of any product purchased from this site. All implied warranties and undertakings are excluded to the maximum extent permitted by law. We are not liable for items damaged as the result of incorrect fitting, modification or misuse. In the event that the product purchased from D-Tech Performance Ltd inadvertently damages or negatively impacts any other component (not purchased from D-Tech Performance Ltd) the liability of D-Tech Performance Ltd shall under no circumstances exceed the price of the supplied goods.

Your right of cancellation
You have the right to cancel the contract at any time up to the end of 7 working days after you receive the goods.
To exercise your right of cancellation, you must give written notice to D-Tech Performance Ltd by letter, fax or via the "contact us" section of our website, giving details of the goods ordered and (where appropriate) their delivery.
Notification by telephone is not sufficient.
If you exercise your right of cancellation after the goods have been delivered to you, you will be responsible for returning the goods to the D-Tech Performance Ltd at your own cost.
You must take reasonable care to ensure the goods are not damaged in the meantime or in transit.
Once you have notified us that you are cancelling the contract, we will refund or re-credit you within 30 days for any sum that has been paid by you or debited from your credit card for the goods.
If you do not return the goods as required, we may charge you a sum not exceeding the direct costs of recovering the goods.
You do not have the right to cancel the contract if the order is for products specifically produced or programmed for your vehicle, or for consumable goods, which, by their nature, cannot be returned.

Applicable Law
These terms of sale and the supply of the goods will be subject to English law and the English courts will have jurisdiction in respect of any dispute arising from the contract.
